Toute prise de commande au titre d'un produit figurant au sein de la boutique en ligne du site web Chrono Carpe.com suppose la consultation préalable des présentes conditions générales. En conséquence, le consommateur reconnaît être parfaitement informé du fait que son accord concernant le contenu des présentes conditions générales ne nécessite pas la signature manuscrite de ce document, dans la mesure où le client souhaite commander en ligne les produits présentés dans le cadre de la boutique du site web. Le consommateur dispose de la faculté de sauvegarder ou d'éditer les présentes conditions générales, étant précisé que tant la sauvegarde que l'édition de ce document relèvent de sa seule responsabilité. The present terms and conditions list the entirety of the obligations of both parties. Therefore, the consumer is considered as having accepted the entirety of the dispositions expressed in those general terms and conditions. Under no circumstances would any other conditions produced or sent by the consumer, and not listed here, be considered or be added to the general terms and conditions hereby stated, as they would be considered incompatible. Article 2 : Purpose
The present terms and conditions have for purpose to define the rights and obligations of all parties with regards to the sale of goods and services offered by the company Chrono Loisirs to the consumer. Article 3 : Contractual documents
The present contract is constituted by the following contractual documents, presented in decreasing hierarchical order: the general terms and conditions, and the order form. In case of any contradiction occurring between dispositions listed in different documents, the dispositions listed in the document highest on the list will prevail. Article 4 : Start time and duration
The present terms and conditions come into place at the date of signature of the order form. These general conditions are agreed on and remain valid for the time needed for the delivery of the goods or services subscribes to, and until the termination of the guarantees as set by the company Chrono Loisirs. Article 5 : Numerical signature
The action of double clicking conducted by the consumer on the order form constitutes a numerical signature which possesses, between the two parties, an identical value to that of a handwritten signature. Article 6 : Order confirmation
The contractual data will be subject to confirmation via email, sent latest whilst delivery is being proceeded with, or to the postal address stated by the consumer via the order form. Article 7 : Proof of transaction
Numerical registers, kept within the computers of the company Chrono Carpe within reasonable security conditions, will be considered as proof of communication, orders and payments which occurred between the parties. Archiving of order forms and invoices is at all times processed using safe and durable computing systems, enabling these documents to be issued as relevant proof. Article 8 : Information on products.
8-a : The company Chronoloisirs displays on its website the goods available for purchase using the characteristics needed to meet the trading standards listed by article L111-1 of the French Consumerism Code, which states that a consumer is entitled to find out about the essential specifications of a product prior to purchasing the given product. 
8-b : The offers promoted by the company Chrono Loisirs only remain valid for as long as stock is available. 
8-c : Products given out free of charge as part of a « with free gift » offer are subjected to change in case of insufficient stock. If such an event should occur, the gift would be replaced by a similar product, of a value equal or superior to that of the original item. 
8-d : Our suppliers reserve their rights to alter some of their product specifications. If any descriptive, typing or photographic inaccuracy appears despite our most vigilant policy on the matter, we cannot not in any case be held responsible for that fact. Article 9 : Prices
Prices are indicated in sterling and are correct at the time of submission of the order form by the consumer. They exclude shipping costs, invoiced as a supplement, and indicated prior to order validation. Prices are inclusive of VAT, at the rate applicable at the time of order. Any change in applicable VAT rate will be automatically applied on the prices displayed in the e-shop. The full amount invoiced needs to be settled at the time of ordering. Under no circumstances can amount paid be considered as deposits of any kind. 
Prices indicated on the website are given under reservation of typing errors. If such an error was to be found, Chrono Loisirs would immediately inform the consumer of the correct price of the item ordered. The consumer will then has the choice of confirming the order with the correct price, or alternatively cancel the order and obtain full reimbursement without any penalties. Article 10 : Means of payment
To settle his order, the consumer may choose any of means of payment listed within the order form. The consumer guarantees where applicable that he has all authorisations to use the mean of payment he has chosen to validate his order, at the time of the order being submitted. The company Chronoloisirs reserves the right to suspend the treatment of any order and delivery if payment would be refused or cancelled by the bank or financial establishment accredited for the means of payment chosen by the consumer. Furthermore the company Chronoloisirs reserves the right to not process or not deliver an order created by a consumer not having fully settled previous orders, or with whom a payment litigation is in process. Chronoloisirs has set a thorough checks procedure to ensure no one can use someone else’s bank details without their knowledge to make a payment. As part of this procedure, you may be asked to produce identification via email, fax or post. In this particular case, the order would only be processed once the identification documents validated. When paying for an order via cheque, processing may be delayed until receipt warrant has been issued. Article 11 : Product availability
11-a : the availability of each product is clearly stated on its presentation screen by coloured lights: green, orange or red.
GREEN = the item is in stock and the order will be processed within 2 working days (outside week-ends and bank holidays) starting form day of ordering. Transport time needs to be added to order processing time (see article 12).
ORANGE = temporary out of stock. The item is on order with the supplier and the average replenishment delay is 15 days. Transport time needs to be added to this delay. The consumer is given the option to be alerted via email when the item becomes available again
RED = Not available. The product is neither available with us nor the supplier. The estimated replenishment date is stated on the description card.
11-b : In case of an unforeseen unavailability of a product (stock take discrepancy for example), the consumer will be informed immediately. Chrono Loisirs will also proceed with the cancellation of all or part of the order, and with the subsequent partial or complete refund. Refund modalities are detailed in article 17.
11-c : concerning the orders settled by differed means of payment (cheques, bank transfers or debit/credit cards over the phone), availability of products cannot be guaranteed. In the event of the item ordered being no longer available at the time payment is received, the consumer will be informed immediately et will be entitled to either proceed to an exchange with an available article, or ask for a refund of part or all of the order. Article 12 : Delivery modalities
Goods ordered will always be delivered at the address stated on the order form. The consumer has a duty to check the good state of the parcels delivered to him, and to notify the transporter immediately in the event of any damage. A statement has to be made in writing on the delivery sheet. The consumer also needs to notify the company Chronoloisirs within 5 working days. The consumer may request that an invoice be sent to an invoicing address different to the delivery address. This request is to be made using the option given on the order form. Chronoloisirs primarily works with four major transport companies: SoColissimo, La Poste, UPS, DPD and TNT.
As soon as we process a shipment, the consumer is notified via email. Despite the great care taken in despatching goods, occasional delays may occur and parcels may be lost, if just temporarily, in transport. It is the consumer’s duty to report any delay in delivery, using as reference date the delivery stated in the notification email. Delivery delays should be notified to us via phone or email. Once notified, we will proceed with an enquiry with the transporter. These enquiries may take up to thirty days. If within the thirty days the shipment is located, it will be redirected to the delivery address. If at the end of the thirty days the shipment is not accounted for, it will be considered by the transporter as lost. Once this declaration of loss issued by the transporter, we will proceed with the shipping of a replacement delivery, without any extra costs occurring for the consumer. If the items initially ordered are no longer available, we would proceed with the full refund. If the prices of any or all the items to be replaced had changed since the time of ordering, we would either refund the difference or ask for the difference depending on the price fluctuation. We cannot be held responsible for transport delays occurring once the shipment is in the hands of the transport company, including loss of parcel or industrial strike. Article 13 : Transport problems due to the transporter
Any discrepancy or problem linked with the delivery (damaged goods, discrepancy with delivery note, damaged parcel…) has to be indicated by the consumer on the delivery note by the consumer, at the time of delivery. These annotations have to be signed by the consumer. These notifications have to be confirmed to the transporter within 48 hours via recorded mail. 14-a : if the delivery is accepted by the consumer, any discrepancy concerning the contents of the delivery (missing item, wrong items in comparison with the delivery note) has to be notified in writing on the transport sheet in presence of the transport company staff, and entitled « delivery reserves », which should be signed by the consumer. The consumer then has the obligation to report these reserves to Chrono Loisirs the same day, or latest the next working day following the delivery. This report should be submitted using the after sales sheet found on the website. 
14-b : Any claim made in that respect will have to be confirmed to the company Chrono Loisirs via recorded mail within three working days following delivery. Claims need to be as detailed as possible, in terms of items missing or not conform to delivery note or damaged. 
14-c : Under no circumstances would claims made outside the guidelines stated in articles 14-a to 14-b, or claims formulated outside the imparted delays, be taken into consideration. Such claims would disengage the company Chrono Loisirs from all its obligations. 
14-d : Upon receiving a claim, and following its validation, Chrono Loisirs will issue a unique product exchange number, which will be communicated to the consumer via email, fax or phone to the consumer. Only once this unique number is released, can replacement items be shipped out. 
14-e : in the event of a delivery mistake or an exchange, any item needing replacement needs to be shipped back to Chrono Loisirs, complete and in its original packaging, using appropriate means of transport. Article 15 : Warranty and Aftersales services
15-a : In compliance with Article 4 of French statutory order n78-464 dated 24th of March 1978, the present dispositions cannot deprive the consumer from the statutory warranty the retailer has to provide against any latent defect of goods sold. The consumer is hereby informed that the Company Chrono Loisirs is not the manufacturer of the products offered for sale on the website, as defined by French Law article 98-389 of 19th of May 1998 relative to faulty manufactured goods. In consequence, any damage or injury which may occur as a result of a faulty product could only engage the legal responsibility of the manufacturer, details of which can be found by the consumer on the original product packaging. 
15-b : For the products benefiting from a « manufacturer warranty », the duration and terms of application of such a warranty are dictated by the manufacturer (duration generally equal to 12 months). By contract, the start date of such warranty is the delivery date of the concerned goods. In order to be eligible to such manufacturer warranty, the product needs not to have undergone any modification, repair or maintenance carried out by parties not accredited by the manufacturer itself. The product concerned needs to have been used in normal conditions of use as defined in the product notice issued by the manufacturer. Under no circumstances can a claim be made for warranty were the product has not been used in accordance with the manufacturers notice. (Fishing rods, Waders, bivvies, luggage and clothing as well as any zips and other closing systems are not covered in case of breakage, tear or puncture).
15-c: In order to submit a claim under warranty, the consumer needs to contact Chrono Loisirs’ own aftersales services, within a maximum of seven days following the finding of the presumed fault. Before proceeding with any product return, a claim must be submitted to and processed by Chronoloisirs’ aftersales services. Such claim has to be submitted using the form available on the sav.chrono-loisirs.fr website page, or sent by post at ChronoLoisirs - SAV - 1 chemin de la Coume - BP 90185 - 09301 LAVELANET CEDEX - FRANCE. In case the consumer is claiming under a manufacturer’s warranty scheme, it is paramount that the claim be made within the duration of the warranty as stated by the manufacturer. Shipping costs for goods returned to Chrono Loisirs and back to the consumer are at the consumer’s expense, and will have to be settled under the conditions defined by Chrono Loisirs’ aftersales service.

Article L 217-4 : Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.
Article L 217-5 : Le bien est conforme au contrat :
1° S'il est propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant :
- s'il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l'acheteur sous forme d'échantillon ou de modèle ;
- s'il présente les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage ;
2° Ou s'il présente les caractéristiques définies d'un commun accord par les parties ou est propre à tout usage spécial recherché par l'acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.
Article L 217-6 : Le vendeur n'est pas tenu par les déclarations publiques du producteur ou de son représentant s'il est établi qu'il ne les connaissait pas et n'était légitimement pas en mesure de les connaître.
Article L 217-7 : Les défauts de conformité qui apparaissent dans un délai de vingt-quatre mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire. Pour les biens vendus d'occasion, ce délai est fixé à six mois. Le vendeur peut combattre cette présomption si celle-ci n'est pas compatible avec la nature du bien ou le défaut de conformité invoqué. 
Article L 217-8 : L'acheteur est en droit d'exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu'il connaissait ou ne pouvait ignorer lorsqu'il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu'il a lui-même fournis.
Article L 217-9 : En cas de défaut de conformité, l'acheteur choisit entre la réparation et le remplacement du bien. Toutefois, le vendeur peut ne pas procéder selon le choix de l'acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l'autre modalité, compte tenu de la valeur du bien ou de l'importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l'acheteur.
Article L 217-10 : Si la réparation et le remplacement du bien sont impossibles, l'acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix. La même faculté lui est ouverte :
1° Si la solution demandée, proposée ou convenue en application de l'article L. 217-9 ne peut être mise en œuvre dans le délai d'un mois suivant la réclamation de l'acheteur ;
2° Ou si cette solution ne peut l'être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l'usage qu'il recherche.
La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur.
Article L 217-11 : L'application des dispositions des articles L. 217-9 et L. 217-10 a lieu sans aucun frais pour l'acheteur.
Ces mêmes dispositions ne font pas obstacle à l'allocation de dommages et intérêts.
Article L 217-12 : L'action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.
Article L 217-13 : Les dispositions de la présente section ne privent pas l'acheteur du droit d'exercer l'action résultant des vices rédhibitoires telle qu'elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi.
Article L 217-14 : L'action récursoire peut être exercée par le vendeur final à l'encontre des vendeurs ou intermédiaires successifs et du producteur du bien meuble corporel, selon les principes du code civil.
Article L 217-15 : La garantie commerciale s'entend de tout engagement contractuel d'un professionnel à l'égard du consommateur en vue du remboursement du prix d'achat, du remplacement ou de la réparation du bien ou de la prestation de tout autre service en relation avec le bien, en sus de ses obligations légales visant à garantir la conformité du bien. La garantie commerciale fait l'objet d'un contrat écrit, dont un exemplaire est remis à l'acheteur. Le contrat précise le contenu de la garantie, les modalités de sa mise en œuvre, son prix, sa durée, son étendue territoriale ainsi que le nom et l'adresse du garant. 
En outre, il mentionne de façon claire et précise que, indépendamment de la garantie commerciale, le vendeur reste tenu de la garantie légale de conformité mentionnée aux articles L. 217-4 à L. 217-12 et de celle relative aux défauts de la chose vendue, dans les conditions prévues aux articles 1641 à 1648 et 2232 du code civil.
Les dispositions des articles L. 217-4, L. 217-5, L. 217-12 et L. 217-16 ainsi que l'article 1641 et le premier alinéa de l'article 1648 du code civil sont intégralement reproduites dans le contrat.
En cas de non-respect de ces dispositions, la garantie demeure valable. L'acheteur est en droit de s'en prévaloir.
Article L 217-16 : Lorsque l'acheteur demande au vendeur, pendant le cours de la garantie commerciale qui lui a été consentie lors de l'acquisition ou de la réparation d'un bien meuble, une remise en état couverte par la garantie, toute période d'immobilisation d'au moins sept jours vient s'ajouter à la durée de la garantie qui restait à courir. Cette période court à compter de la demande d'intervention de l'acheteur ou de la mise à disposition pour réparation du bien en cause, si cette mise à disposition est postérieure à la demande d'intervention.
Article L 217-17 : Les prestations de services après-vente exécutées par le vendeur et ne relevant pas de la garantie commerciale visée à la section 3 font l'objet d'un contrat dont un exemplaire est remis à l'acheteur.
Article L 217-18 : La mise en service effectuée par le vendeur comprend l'installation et la vérification du fonctionnement de l'appareil. La livraison ou la mise en service s'accompagne de la remise de la notice d'emploi et, s'il y a lieu, du certificat de garantie de l'appareil.
Article L 217-19 : Le vendeur indique par écrit à l'acheteur lors de son achat, s'il y a lieu, le coût de la livraison et de la mise en service du bien. Un écrit est laissé à l'acheteur lors de l'entrée en possession du bien, mentionnant la possibilité pour l'acheteur de formuler des réserves, notamment en cas de défauts apparents de l'appareil ou de défaut de remise de la notice d'emploi.

Article L 217-20 : Lorsqu'il facture des prestations de réparation forfaitaires, le vendeur doit, par écrit, informer l'acheteur de l'origine de la panne, de la nature de l'intervention et des pièces ou fournitures remplacées.  

Article 16 : Right to withdraw
The consumer benefits from a 14 working days period to return, at his expense, products ordered which he would not deem suitable. This period starts on the day the consumer was delivered the products concerned. If this period expires on a Saturday, Sunday, or on a Bank Holiday, the period is prolongated to the first following working day. Prior to any return, all relevant information will have to be passed on to Chrono Loisirs’ customer services, using the “follow your order” page of the website, on which you will, once your customer number entered, be able to retrieve your order number. Using this number, the consumer will apply for a return number. No returns without a valid return number will be accepted. Returns will have to be insured against their value and shipped to Chrono Loisirs "return n° " - 1 chemin de la Coume - BP 90185 - 09301 LAVELANET CEDEX - FRANCE.
Products such as CDs, DVDs will have to remain sealed in order to be accepted as returns. 
Electronic devices are also subject to a 14 day withdrawal period.
Only products returned as a whole, in their original packaging and intact, i.e. in perfect resalable condition, will be accepted for refund. Products returned damaged, or in damaged packaging, will under no circumstances be eligible for refund. 
This right to withdraw is free of any penalties, with the exception of shipping costs for the returned goods. In the event of exerting this right, the consumer is entitled to ask for either a replacement product or the refund of sums initially paid. (as detailed in article 17).
In the event of the consumer exerting his right of withdrawal, the company Chrono Loisirs will make all efforts to deal with the consumer’s request in the quickest possible time. However, due to the technical characteristics of the products sold, this delay may be extended to up to 30 days, especially when the product returned needs technical testing to assess its condition. Article 17 : Refund
Regardless of the grounds for reimbursement, refunds will be processed by means of payment available to the company Chrono Loisirs, and within reasonable delay, never exceeding 30 days form reception of the claim via recorded mail. Under no circumstances will a refund be made prior to the invoice being fully paid. Article 18 : Rights of usage
The rights of usage of the software property of the Company Chrono Loisirs and that of those distributed by the company, is given to the consumer in a non-exclusive, individual and non-sharable context, in conformity with the Intellectual Property Code. However, Article L122-6-1 of this Code enables the consumer to execute copies for the sole purpose of saving data in order to preserve the use of the concerned software. The software concerned remains nevertheless the sole and entire property of its creator, which the consumer fully accepts. Article 19 : Unforeseeable circumstances
Neither of the parties will have failed to fulfil their contractual obligations in the event that their execution may be delayed, obstructed or impeached by unavoidable and clearly unforeseeable circumstances. Will be considered as such circumstances any unavoidable event not induced by any of the parties, and of which the unpredictable and unavoidable character will be established, as well as the absence of any link of causality with either of the parties bound by the contract. It will also have been established to define such unforeseeable circumstances that none of the efforts to be reasonably expected from either party could have prevented those circumstances from occurring. The party afflicted by such circumstances has an obligation to inform the other party within ten working days starting on the day the prejudice will have been recognised. Both parties will then convene of the conditions under which the contractual obligations may resume and be completed. If the unforeseeable consequences hamper the completion of the contractual obligations for a duration exceeding 3 months, the aggrieved party will be able to exert the right to terminate the present general terms and conditions. Are expressively considered as unforeseeable circumstances, as well as those usually accepted by French courts and test cases: the blocking of means of transportation and replenishment, heart quakes, fire, floods, lightning, breakdown of communication networks not caused by any of the contractual parties. Article 20 : Partial invalidation
In the event that one or more of the present stipulations of these general terms and conditions would be rendered null and voided or obsolete by new legislation issued by a competent body, all the other stipulations will remain valid and keep their power as contractual obligations. Article 21 : Waiver clause
For one of the parties not to claim a lack of compliance to contractual obligations by the other party, will not, and never, be later on considered as a renunciation of the obligations concerned. Aticle 22 : Title
In case of any difficulty of interpretation between a given clause and its title, the titles concerned will be declared non-existent. Article 23 : Applicable law
The present general terms and conditions are liable to French Law. This applies for all articles in form and substance. In the event of claims or litigations, the competent court will be that, defined by the conditions of the Common Law. Article 24 : Data and Protection act
Data requested from the consumer in order to process his order may be passed on to contractual partners of the company Chrono Loisirs involved in the processing of that order. The consumer retains the right to inform the company Chrono Loisirs (using the address mentioned in the confidentiality Charter of the website) in order to oppose such passing on of details, or to exert their right of access and modification of their personal data recorded with Chrono Loisirs, as dictated by the French Article of Law of 6th of January 1978.
